Disclaimer
1. Liability; Indemnification
1.1. Caterer shall not be liable for:
(a) any foodborne illness or related issue arising from the handling, storage, or consumption of food after the Services have concluded; or
(b) any damages, injuries, or losses caused by guests, venue staff, or third parties.
1.2. Client shall indemnify, defend, and hold harmless Caterer and its agents from any claims, damages, or liabilities arising from:
(a) the condition or suitability of the Event venue;
(b) actions or omissions of Client, guests, or third parties;
(c) any breach of this Agreement by Client.

2. Force Majeure
Neither Party shall be liable for failure to perform its obligations due to events beyond reasonable control, including but not limited to natural disasters, acts of government, labor disputes, or public emergencies. Payments for Services already performed or expenses already incurred remain due.
3. Compliance
Caterer shall maintain all required permits, licenses, and health-safety compliance obligations. Client shall be responsible for ensuring the venue permits the Services and provides adequate access, utilities, and timing for setup and breakdown.

4. Photography Release
Unless otherwise stated in writing by Client, Client grants Caterer permission to photograph food displays and non-identifying setup elements for marketing or portfolio purposes. No identifiable images of guests shall be used without separate written consent.

5. Right to Withdraw / Early Departure
Caterer reserves the right, without penalty, to cease performance of Services and depart the Event prior to the scheduled conclusion time under any of the following circumstances:
5.1 Unsafe Conditions.
If Caterer, in its reasonable discretion, determines that the Event environment poses a risk to the health, safety, or well-being of Caterer’s staff, equipment, or property. Unsafe conditions include but are not limited to: physical altercations, threats, harassment, disorderly conduct, obstructive crowding, or hazardous venue conditions.
5.2 Interference With Services.
If Caterer’s ability to perform Services is materially impaired by Client, guests, venue personnel, or third parties, including interference with setup, presentation, staffing, or access to required utilities.
5.3 Unlawful Activity.
If Caterer witnesses or is requested to participate in any activity that is illegal under state or federal law, or if illegal activity at the Event creates a reasonable risk of liability or harm.
5.4 Non-Payment.
If payment obligations outlined in Section 5 are not satisfied prior to the Event start time, Caterer may refuse to commence Services or may depart.
5.5 Venue Non-Compliance.
If the venue refuses to permit Caterer to operate in accordance with local health codes, safety standards, or Caterer’s equipment requirements, or denies promised access (including parking, loading zones, workspace, or electrical needs).
5.6 Effect of Withdrawal:
If Caterer withdraws pursuant to this Section, Client shall remain liable for all fees due under this Agreement, and no refunds shall be issued. Caterer shall not be liable for any damages, losses, or claims arising from withdrawal under this Section.
